Data Protection and Privacy Policy

Positickets is committed to protecting your privacy and takes very seriously its responsibilities regarding the security of user information.
This Data Protection and Privacy Policy explains how we use the information and how we protect your privacy.

  1. Data Controller
    1. When you send your data to Positickets, the data controller is Trencham Associates Ltd, registered under the Data Protection Act 2018, registration no. A8268992.
  2. Customer information required to process your booking
    1. Credit/debit card payments are processed securely via a fully compliant, 3rd-party payment service provider e.g. Payal, WorldPay, ParentPay.
    2. We require certain information to allow us to process your event booking. This includes, for example, your name, address, email address and telephone number.
    3. This information allows us to process your booking and either to provide your information to the event organiser so they can send you tickets by post, or to send you an e-ticket confirmation by email. We ask for your telephone number so that you can be contacted urgently if there is a problem with your booking.
  3. Legal Basis
      There are three bases under which we may process your data:
    1. Contract purposes When you make a purchase from us or make a donation to us, you are entering into a contract with us. In order to perform this contract we need to process and store your data. For example we may need to contact you by email or telephone in the case of cancellation of a show, or in the case of problems with your payment.
    2. Legitimate business interests In certain situations we collect and process your personal for purposes that are in our legitimate business interests. However we only do this if there is no overriding prejudice to you by using your personal information in this way. We describe below all situations where we may use this basis for processing.
    3. With your explicit consent For any situations where the two bases above are not appropriate, we will instead ask for your explicit consent before using your personal information in that specific situation.
  4. Positickets Show Update Service
    1. You may be invited to join the Positickets Alert Service. If you agree, your name, location, email address and possibly show preferences will be stored. When a show meeting your criteria opens booking through Positickets, we will send you an email inviting you to view the details of the show and potentially book. We may use a third party email delivery company to send these emails and they will only be given your data to carry out each mailing.
  5. Competitions/campaigns/feedback
    1. When you enter a Positickets competition or other promotional offer, we may ask for your name, address and e-mail address so we can administer the contest and notify winners.
    2. Occasionally we may contact you to ask your opinion on a particular topic relevant to events. We may publish a selection of the comments we receive on our web site (unless you advise us that you do not wish to have your comment and name published – in which case we will not do so).
  6. Security / retention of data
    1. When you enter credit or debit card information, your details are transmitted across the internet using secure encryption technology.
    2. As required by the UK Data Protection Act 2018, we have strict security procedures on the storage and disclosure of the personal data of our users. This means that we may occasionally request proof of identity before we disclose sensitive information to you.
    3. Under this policy, where we pass your information to a third party, we will use our best endeavours to ensure that the data security measures that the third party has in place are equal or stronger than ours. This does not apply where we are required by law to pass your information to a third party.
    4. Your data may be disclosed to a third party such as a law-enforcement agency or your employer, where we find that you have posted offensive or objectionable content anywhere on our site, or have otherwise engaged in disruptive behaviour through our site. Equally we may use your personal data in order to take reasonable steps to stop such behaviour.
    5. We will keep your information for a reasonable period or as long as the law requires.
  7. Cookies
    1. Cookies are small code files placed on your computer's hard drive. Our cookies do not contain any personally identifying information.
    2. However they enable Positickets to provide features such as remembering your location, so that next time you visit Positickets, we can put the shows nearest to you on the front page as you arrive at the site – making your experience with Positickets quicker and easier.
    3. Cookies may also be used to understand which of the adverts that may be displayed on our site from time to time you click on, and then to select only adverts that are most relevant to you on subsequent visits. We may use a third party or alternate service to manage this process.
    4. Cookies may also be used to compile anonymous statistics on how the services on our site are used and to measure the website’s performance. A third party may be used to collect and analyse this data.
    5. Most web browsers automatically accept cookies, but you can change your browser settings to block them, and if you wish you can delete cookies from your hard drive, although either of these options may affect your use of the site.
    6. Cookies are also used in some emails and on our website to help us measure how visitors use our site, and the effectiveness of our advertising.
    7. We do use cookies to store information, such as your personal preferences when you visit our site. This could include only showing you a popup once in your visit, or the ability to login to some of our features, such as forums. We also use third party advertisements to support our site. Some of these advertisers may use technology such as cookies and web beacons when they advertise on our site, which will also send these advertisers (such as Google through the Google AdSense program) information including your IP address, your ISP , the browser you used to visit our site, and in some cases, whether you have Flash installed. This is generally used for geotargeting purposes (showing New York real estate ads to someone in New York, for example) or showing certain ads based on specific sites visited (such as showing cooking ads to someone who frequents cooking sites).
      DoubleClick DART cookies
      We also may use DART cookies for ad serving through Google’s DoubleClick, which places a cookie on your computer when you are browsing the web and visit a site using DoubleClick advertising (including some Google AdSense advertisements). This cookie is used to serve ads specific to you and your interests (”interest based targeting”).
      The ads served will be targeted based on your previous browsing history (For example, if you have been viewing sites about visiting Las Vegas, you may see Las Vegas hotel advertisements when viewing a non-related site, such as on a site about hockey). DART uses “non personally identifiable information”. It does NOT track personal information about you, such as your name, email address, physical address, telephone number, social security numbers, bank account numbers or credit card numbers.
      You can opt-out of this ad serving on all sites using this advertising by visiting http://www.doubleclick.com/privacy/dart_adserving.aspx
      You can choose to disable or selectively turn off our cookies or third-party cookies in your browser settings, or by managing preferences in programs such as Norton Internet Security. However, this can affect how you are able to interact with our site as well as other websites. This could include the inability to login to services or programs, such as logging into forums or accounts.
      Deleting cookies does not mean you are permanently opted out of any advertising program. Unless you have settings that disallow cookies, the next time you visit a site running the advertisements, a new cookie will be added.
  8. Disclosure to third parties
    1. Positickets will provide your information to trusted third parties such as the event organisers, in order to ensure you are able to gain access to the venue correctly.
    2. If you have given us your express permission, we may also find some other companies that have information or products we think you will be interested in and pass them your details so they can contact you directly. They will not be allowed to use your information for any other reason unless approved by you, and if at any time you withdraw your consent, we will use our best endeavours to ensure that they no longer keep your data.
  9. Your consent
    1. In using the Positickets web site, you consent to the collection and use of your data by Positickets in the ways described above.
    2. If at any time we decide to change our Privacy Policy, we will post the changes on this page so that you can always be aware of what information we collect, how we use it and in what circumstances we disclose it.
